At this moment, the following evidence indicated it was the eastern Ukraine pro-Russian militants who fired a surface-to-air Buk missile and shot down the MH17 :

However, while the militants could have control some of the eastern Ukraine area, the Ukraine air traffic control is still in control of the sky communication with all civilian aircraft, and they are also fully aware that:
- the militants are heavily armed, with strong support from Russia
- capable of shooting down Ukraine's cargo plane & fighter jet, which happened recently
- in possession of the dangerous Buk missile, just days before MH17 was shot down
Knowing these, why the Ukraine authority still allow civilian aircraft continue to fly at that hot area ?
MH17 did request to fly at 35,000 ft (10,600m), is there any specific reason why Ukraine air control instructed MH17 to fly at 33,000 ft (10,300m) ?
In any war & conflict situation, one must understand there is no such thing as to I'm good guy and you are bad guy. All parties who are involved in the war can be equally ugly & dirty to get thing done. While the militant is to be blamed for this tragedy, the Ukraine part can't deny the fact that they could have done something to prevent this tragedy from happening.
It's so sad beyond words to see the innocent MH17 ended in the middle of this ugly war situation, so terribly unfortunate at the wrong place at the wrong time.
